Whereas the lessor is the owner of the residential flat described
in the schedule attached hereto and is willing to let the said
building on lease (hereinafter referred to as the said flat)
And whereas the lessee has approached the said lessor for the
grant of lease of the said flat.
NOW THIS DEED WITNESSETH AS UNDER:
A) That in pursuance to the said Agreement and in consideration
of the rent hereby reserved and on the terms and condition contained
herein the lessor both hereby grant the lease of the said flat
together with the fixtures, fittings and appurtenances attached.
The said rent shall be payable in advance and should be paid
by the 7th of every month without delay or default.
B)The lessee hereby agrees with the Lessor as under:
- To pay
the said rent free and clear from all deductions on or before
of every calendar month in advance during the tern of lease
which shall be paid at the address of the lessor mentioned
above.
- To pay
his share of all the rates, taxes, assessments, cesses and
impositions whatsoever charged by municipal or other authority
on the above flat or any part thereof.
- To keep
and maintain the said flat and all windows, doors, fixtures,
interior walls, pipes, and other appurtenances, in good and
substantial repair and in clean condition.
- To allow
the lessor or his servant or agent to enter the said premises
at all reasonable hours and to examine the condition of the
flat.
- To undertake
repairs/ replacement of minor nature and not to undertake
any structural addition or alteration in the said flat without
lessors prior consent.
- To insure
the said flat against loss or damage by fire with an Insurance
Company.
- To use
the said premises for bona fide residential purpose for himself
and the members of his family and not for any business or
commercial purposes.
- Not
to assign or part with the said flat or grant sub lease to
deliver to the same or part thereof to any person or persons
without the prior consent of the lessor.
- On termination
or earlier determination or the lease to deliver to the lessor
peaceful and vacant possession of the said flat without removing
any improvements made therein and without claiming any compensation
for the same.
C) The
lessor hereby agrees with the lessee as under:
- To pay
his share of house tax and other charges livable on the said
flat.
- To allow
quite and peaceful enjoyment of the said flat during the tern
of lease without any interference or disturbance by the landlord
or his agent or servant or any person claiming him, as long
there is no default on the part of lessee.
- To keep
the external part of the said flat in good repair and to undertake
major repairs.
D) It is hereby agreed between the parties that:
- If there
is any default on the part of the lessee in payment of rent
or part thereof for a continuous period of
month or if
there is breach of any of the clauses of the lease deed on
the part of the lessee then the lessor or any person (s) authorized
by him in this behalf my enter upon and take possession of
the said flat the amount of rent in arrear or the clause violated
and the lessee has failed to pay the arrear or has failed
to comply with the condition violated within 15 day of the
service of the notice.
- If at
any time the said residential flat is rendered unfit for residential
purpose not due to default on the part of lessee the lessor
shall reinstate the same it his own expenses.
E) The
lease deed shall be executed in duplicate, original to be kept
by the leasor and the duplicate to be kept by the lessee.
F) The stamp duty and other expenses incurred in connection
with the lease shall be borne by the lessee. IN WITNESS WHEREOF
the lessor and the lessee have executed this lease deed on the
day, month and year above written.
