LEAVE AND LICENCE
THIS AGREEMENT OF LEAVE AND LICENCE executed at _________

BETWEEN
__________________, a Company incorporated under the Companies
Act, 1956, represented by its _______________, ____________________,
having its registered office at _____________________________,
hereinafter called " THE LICENSOR" (which expression
shall, unless it is repugnant to the context, mean and
include its successors-in-interest, administrators
and permitted assigns):
AND
________, Son of /wife of/daughter of ______________,
Indian, ________, aged about ____ years, residing at ___________________________
hereinafter referred to as "THE LICENSEE".
WHEREAS
1. The LICENSOR is the absolute owner of the commercial
premises, namely, ___________________more fully described
in Schedule hereto.
2. The LICENSEE has requested the LICENSOR for the use
and occupation of the _______
being the ______________ bearing shop number: ______________
of Schedule property, hereinafter referred to as THE
LICENSED PREMISES and more fully described in Schedule
B hereto, on leave and licence basis for________________________________________.
3. The LICENSOR has agreed to grant leave and licence
to the LICENSEE to occupy and use THE LICENSED PREMISES
on the following terms and conditions agreed between the
parties hereto:
NOW THEREFORE IN CONSIDERATION OF THE MUTUAL OBLIGATIONS
AND UNDERTAKINGS CONTAINED HEREIN THIS AGREEMENT WITNESSETH
AS FOLLOWS:
TERM AND TERMINATION:
The LICENSOR hereby grants leave and licence to the LICENSEE
to occupy and use THE LICENSED PREMISES for a period
of ________________________________________.
The licence shall stand automatically revoked on the expiry
of the said term of licence.
The LICENSOR shall be entitled to terminate this agreement
of licence anytime during the term of licence by issuing
notice to the LICENSEE and the LICENSEE shall vacate and
hand over the vacant possession of the premises to the
LICENSOR within __________________________.
LICENSE FEE OR COMPENSATION
The LICENSEE shall pay the LICENSOR a sum of _________________________
towards License Fee, on ________________.
The LICENSEE shall pay the LICENSOR an amount of ______________________________
towards security deposit for ________________________________.
The said security deposit shall not carry any interest.
LICENSORS RIGHTS & DUTIES
All internal and external repairs including painting of
THE LICENSED PREMISES _______
_______________________ shall be carried out by the LICENSOR

All levies, municipal taxes and the other taxes in respect
of THE LICENSED PREMISES
shall be paid by the LICENSOR.
The LICENSOR shall lock up the ________________________________
by ________ and thereafter ingress and egress to and from
THE LICENSED PREMISES would not be permitted or possible
till ________________ except with prior intimation or
in case of an emergency.
LICENSEES RIGHTS & OBLIGATIONS
The LICENSEE directly to the authorities concerned shall
pay the electricity charges for electricity consumption
in the said LICENSED PREMISES and the LICENSOR shall
not be responsible for the same. The LICENSOR shall provide
a ______________ in THE LICENSED PREMISES for this purpose.
Water charges will be computed pro rata and the LICENSEE
shall pay the water charges to the LICENSOR.
THE LICENSED PREMISES shall be used only for the purpose
agreed to by the parties and mentioned herein above and
for no other purpose.
The THE LICENSED PREMISES has electricity fittings and
fixtures. The LICENSEE may at his own cost, install any
additional fittings and fixtures. The LICENSEE shall remove
such fittings and fixtures installed by him, on the termination
of the licence without damaging THE LICENSED PREMISES
The LICENSEE shall not transfer the licence under this
agreement to any person or entity. The LICENSEE is not
entitled to permit any person or entity to occupy the
said premises or any portion thereof.
The LICENSEE shall maintain the THE LICENSED PREMISES
in good condition and shall not cause any damage, subject
to reasonable wear and tear and usage.
JURISDICTION OF THE COURT
The Courts ____________ shall have exclusive jurisdiction
over any dispute with respect to any matter arising under
this Deed.
